State filings for breweries: what to expect

The state licenses, brand registrations and reports that sit alongside your federal filings.

Federal approval is only half the job. Most breweries also deal with their state alcohol agency, and every state sets its own forms, fees and deadlines. Here is what usually applies, and where to look.

The usual state filings

  • State license or permit

A manufacturer’s license for your premises, often with a local or county step. Many states want your federal application filed or approved first.

  • Brand or label registration

Many states require each brand or label to be registered, often with a copy of the approved COLA, before it can be sold there.

  • State excise tax reports

Most states collect their own alcohol tax with monthly or quarterly reports. The forms and due dates differ from TTB’s.

  • Shipping and distribution permissions

Selling direct to consumers, self-distributing or selling to out-of-state wholesalers each need separate permission, and some states don’t allow some of them.

  • Renewals

State licenses and brand registrations renew on each state’s own cycle.

Find your state agency

TTB keeps a directory of state alcohol beverage control boards with links to each agency. Always use the agency’s own site for current forms and fees.

Questions

Do I need state approval as well as TTB approval?

Almost always. Federal approval doesn’t license you in a state; each state has its own license and often its own brand registration.
